1. Preamble
These Terms and Conditions ("Terms") govern your rights and obligations regarding the trading games and services ("Virtual Trading," "Evaluations," "Services") offered by TRADERSYARD, primarily accessed via www.tradersyard.com.
Please read these Terms carefully. By accessing or using our Services, you confirm that you understand and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Services.
TRADERSYARD reserves the right to amend these Terms at any time at our sole discretion. We will notify you of any changes in writing, either via email or directly through the TradersYard network information services. You have the right to object to these modifications. If we do not receive a formal objection from you within one week of the notification being sent, your continued use of the Services will constitute your acceptance of the updated Terms.
2. General Conditions & Service Overview
2.1 Declaration of Consent
By registering on www.tradersyard.com or utilizing our services, you enter into a binding contract with TRADERSYARD. These Terms form an integral part of this contract, and your use of the platform constitutes your agreement to be bound by them.
2.2 Services
Our services include simulated stock exchange trading (trading games), analysis tools, a trading platform, real-time data feeds, a social network, educational materials, and access to third-party applications and webinars.
All financial market data is used solely for simulated trading. You acknowledge that all trades and funds within the platform are strictly virtual. Virtual funds cannot be withdrawn, and unless expressly agreed otherwise, you are not entitled to any real financial compensation or profits, nor are you liable for any simulated losses.
The TRADERSYARD Evaluations are strictly for educational purposes to familiarize users with financial markets without financial risk; they do not constitute financial services. Furthermore, our competitions and tournaments are games of skill. They do not constitute gambling, as outcomes are predominantly determined by the participants' financial market knowledge and trading proficiency rather than chance.
2.3 Exclusion of Investment Advice and Services
TRADERSYARD does not provide investment services, advice, or recommendations within the meaning of applicable law. Any information provided by TRADERSYARD, its employees, or its media channels is strictly for educational purposes. We provide no guidance or instructions on how you should conduct simulated transactions.
TRADERSYARD assumes no liability for the actions of users, unauthorized third parties, or for any trading recommendations shared between users within the TRADERSYARD social network. Users are solely responsible for evaluating the validity and authorization of any information received from other participants.
2.4 No Fiduciary Relationship or Agency
Nothing in these Terms creates a fiduciary relationship, joint venture, partnership, agency, or employment relationship between you and TRADERSYARD. You act solely on your own behalf and are not authorized to bind TRADERSYARD in any capacity.
2.5 Minimum Age and Promotional Eligibility
You must be at least 18 years of age to register for or use TRADERSYARD Services. By accessing the platform, you confirm you meet this requirement. It is your sole responsibility to ensure your use of the Services complies with the laws of your jurisdiction.
If you participate in any platform giveaways, tournaments, or competitions while under the age of 18, you are entirely ineligible to receive or claim any resulting accounts, rewards, or prizes. This disqualification is absolute and remains permanent even after you turn 18. All giveaway and tournament activities are subject to these overarching Terms and Conditions.
2.6 Local Compliance Responsibility
You are solely responsible for ensuring that your access to and use of the Services complies with all applicable laws in your jurisdiction. TRADERSYARD assumes no responsibility for your legal compliance and reserves the right to terminate your access upon identifying any violation.
3. Registration, Accounts & KYC
3.1 Registration
You may request to use our services by completing the relevant registration or order form on the TRADERSYARD website, or by processing a payment for an Evaluation through our authorized payment providers.
The presentation of services on our website does not constitute a legally binding offer from TRADERSYARD. By submitting an order, you are making a binding offer to us. A contract is only concluded when we accept your offer, which occurs when we send an order confirmation via email and grant you access to the selected service.
Our Services are available exclusively to individual natural persons acting in a personal capacity. Registration, purchase, or use of the Services by legal entities, corporations, partnerships, or any other commercial organization is strictly prohibited. You are solely responsible for ensuring that all data provided during registration is complete, accurate, and current, and you must notify us immediately of any changes via [email protected].
Depending on your local jurisdiction, reaching specific Performance Reward thresholds may legally require you to establish a registered business structure (such as a sole proprietorship). TRADERSYARD does not provide legal, tax, or regulatory advice, and it remains strictly your sole responsibility to identify, understand, and comply with all applicable local legal, tax, and registration requirements.
TRADERSYARD explicitly disclaims any and all liability arising from your continued use of the Services in the event you fail to meet your local legal, tax, or corporate registration obligations. Any fines, penalties, tax liabilities, or legal consequences resulting from your non-compliance are entirely at your own risk and expense.
3.2 Data Verification and Correction
You may review, correct, and amend your personal data at any point before final submission of the registration or order form. Any modifications to personal data after registration has been completed cannot be made manually and must be submitted via a formal request to [email protected] for review and verification.
Upon successful payment, TRADERSYARD will issue an immediate order confirmation via email. The contract for the selected evaluation version is formally concluded upon receipt of payment, which grants you access to the trading environment.
3.3 Account Security, Registration, and Dashboard Access
TRADERSYARD provides each user with a single, individualized dashboard linked to one unique email address. Creating multiple accounts whether directly, via duplicate profiles, or by utilizing aliases, related persons, household members, or third-party proxies is strictly prohibited and constitutes a material breach of these Terms.
To protect against circumvention, TRADERSYARD reserves the right to suspend accounts pending a compliance review if multiple accounts share an IP address or device, or exhibit coordinated trading patterns indicating a single controlling entity. You bear sole responsibility for maintaining the strict confidentiality of your login credentials, which may not be shared with any third party. You must notify us immediately of any suspected security breach, though TRADERSYARD reserves the right to proactively force a password reset for system security. You are exclusively responsible for all activities conducted through your dashboard, and you waive any right to claim compensation for losses arising from unauthorized access resulting from your omissions. Any violation of these rules, including attempts to bypass our security infrastructure, will result in the immediate, non-refundable termination of all associated accounts and the instant forfeiture of any active Evaluations, fee repayments, or pending Performance Rewards.
3.4 Personal Data & Retention
The processing of users' personal data is carried out in accordance with the separate data protection provisions of the operators of the website: TRADERSYARD and possible subsidiaries or affiliates. The definitions, terms and abbreviations used in these terms and conditions can be found under "Explanation of terms".
TRADERSYARD maintains an electronic record of the concluded contract and processes all personal data in strict accordance with the General Data Protection Regulation (GDPR) and applicable data privacy laws. All personal data collected during the KYC process is encrypted and processed securely. This data is retained strictly for as long as necessary to fulfill our legal, regulatory, and dispute-resolution obligations, in full compliance with the General Data Protection Regulation (GDPR). 3.5 Identity Verification (KYC) and Anti-Money Laundering (AML)
3.5.1 Standard KYC Verification
To ensure platform integrity and comply with applicable financial regulations, including Anti-Money Laundering (AML) and Counter-Terrorism Financing (CTF) laws, TRADERSYARD requires strict identity verification and reserves the right to request comprehensive Know Your Customer (KYC) documentation at any time.
We utilize Sumsub, a secure and trusted third-party provider, to conduct all Know Your Customer (KYC) processing. Through Sumsub's secure portal, you will be required to submit documentation to verify your identity. This may include, but is not limited to, a valid government-issued ID, proof of residence, and documentation verifying your source of funds. You agree to cooperate fully and promptly with any such compliance requests.
3.5.2 Enhanced KYC and Tax Identification (TIN)
In addition to standard KYC verification, TRADERSYARD enforces an Enhanced KYC process once a user's accumulated Performance Rewards reach specific financial thresholds. When this threshold is triggered, you will be required to provide:
- A valid Tax Identification Number (TIN) or local TAX ID.
- A recently issued and verified proof of address.
- Any additional information or documentation deemed necessary for ongoing regulatory compliance.
Tax Compliance Disclaimer: TRADERSYARD collects your TIN/TAX ID strictly for internal compliance, fraud prevention, and record-keeping purposes. TRADERSYARD does not act as a withholding agent, does not report your earnings to any local or international tax authorities, and assumes absolutely no liability or responsibility for your personal tax affairs. You remain strictly and solely responsible for calculating, reporting, and remitting all applicable taxes related to any rewards or income derived from the Services.
3.5.3 Mandatory KYC Triggers
Standard KYC verification is mandatory and must be successfully completed in the following circumstances:
- Before advancing to any Reward-Eligible stage or executing a Master Agreement.
- Before the processing of any Performance Reward.
- Before claiming any tournament prize, promotional reward, or activating a Giveaway Account.
- Upon reasonable suspicion of fraudulent activity, platform misuse, or terms violation.
3.5.4 Consequences of KYC Failure and Right to Pause Payouts
Right to Pause Payouts (TIN & Tax Compliance): TRADERSYARD reserves the right to temporarily pause or withhold Performance Reward payouts, suspend trading access, or refuse further contract execution if you fail or refuse to provide a valid Tax Identification Number (TIN) or specific tax compliance documentation upon request. Payouts will remain paused until all requested tax documentation has been successfully submitted and verified.
Failure to pass or comply with either the standard or enhanced KYC verification processes will result in the immediate suspension or permanent termination of your Evaluations and access to the Services, without refund. Furthermore, it will result in the immediate forfeiture of any pending Performance Rewards, prizes, or Giveaway Accounts, and the permanent cancellation of your Reward-Eligible status or associated contracts.
3.6 Prohibited Jurisdictions (General services)
To comply with international regulations and sanctions, we maintain a list of prohibited jurisdictions. Citizens, residents, and individuals physically located in (including tourists or temporary visitors) the following countries are strictly restricted from using our services: Iran, North Korea, Myanmar, the Russian Federation, and Belarus. This list may be updated periodically to reflect changes in legal or regulatory requirements. Users attempting to register or access services from these jurisdictions will be denied access, and any accounts found to be in violation may be suspended or terminated.
3.7 Official Communication and Contact Information
All official communication regarding the Services will be conducted by TRADERSYARD or its authorized partners via your registered email address, telephone number, or directly through the User Dashboard. You expressly acknowledge and agree that all electronic communication (whether by email, or via the User Dashboard) satisfies any legal requirement that such communications be in writing.

4. Right of Withdrawal & Refund Policy
4.1 General Right of Withdrawal
As a consumer under the Austrian Distance and Off-Premises Contracts Act (§11 FAGG), you generally have the right to withdraw from this contract within fourteen (14) days from the date of conclusion without providing any reason. To exercise this right, you must notify us of your decision to withdraw via an unequivocal written statement (e.g., an email to [email protected]) before the withdrawal period expires. If a valid withdrawal is requested, we will reimburse the Evaluation fee within 14 days using the same payment method used for the original transaction.
4.2 Loss of Right of Withdrawal (The "First Trade" Rule)
Our Services consist of digital content and immediate access to simulated trading environments. By logging into the platform and executing your first simulated trade, you expressly consent to the immediate commencement of the contract before the 14-day withdrawal period expires. You explicitly acknowledge and agree that upon executing your first trade, the service is deemed fully consumed, and you irrevocably lose your right of withdrawal and any entitlement to a refund.
4.3 General Refund Restrictions
Subject to your statutory right of withdrawal, by submitting your payment and gaining immediate access to the digital services and Evaluation environment, you acknowledge and agree that all fees are otherwise non-refundable. No refunds will be granted under any other circumstances, including but not limited to account termination or early cessation of the service.
4.4 Tournament Participation and Refund Waiver
By paying the entry fee or clicking the button for free entry into a TRADERSYARD Tournament, a binding participation agreement is formed. Your right of withdrawal and any eligibility for a refund of the participation fee permanently expires at the exact moment the Tournament officially starts, regardless of whether you have executed any trades.
5. Fees, Payments & Tax Obligations
5.1 Fees and Payments
Access to a TRADERSYARD Evaluation requires the payment of a one-time fee. Fees vary depending on the specific Evaluation selected and are clearly outlined on our website. Unless explicitly agreed otherwise, any discounts, vouchers, or promotional benefits are not cumulative. TRADERSYARD reserves the right to modify the fees, structures, and completion parameters of its Evaluations at our sole discretion.
5.2 Purchases and Service Availability
Nothing on this Website or any Brand Sites constitutes a legally binding offer to buy or sell any products or services in any jurisdiction. All details, descriptions, prices, and other information regarding products or services displayed on the Website are of a general nature and are subject to change. TRADERSYARD does not guarantee that any specific product or service will be available at the time or location you wish to make a purchase. Our legal obligations with respect to any purchased products or services are governed exclusively by the specific agreements under which they are provided. Nothing contained on this Website shall be construed to alter, supersede, or modify those separate agreements.
5.3 Terms of Payment
Evaluation fees are calculated and based in Euros (EUR). If you elect to pay in an alternative supported currency listed on the Website, the final amount will be converted based on the current exchange rate applied by our payment provider at the time of the transaction. You acknowledge that you bear the risk of any exchange rate fluctuations and conversion costs.
Payments made via credit card or express payment methods are due immediately upon checkout. You are solely responsible for paying any transaction fees, surcharges, or processing costs levied by your chosen payment service provider. You must ensure that the exact, full fee applicable to your selected evaluation is transferred to and received by TRADERSYARD without any deductions. Fees may be paid using any of the available payment methods currently offered on the Website checkout page.
5.4 Payment Data Security
TRADERSYARD does not collect, process, or store your sensitive payment data on our servers. All financial transactions are managed and secured exclusively through independent, third-party payment service providers.
5.5 Suspension of Services and Payment Disputes
TRADERSYARD reserves the right to immediately suspend or permanently terminate access to all current and future Services if a user initiates an unfounded chargeback, payment dispute, or reversal request with their bank, credit card issuer, or payment processor.
Any such dispute resolution procedure will result in the immediate revocation of your access to the evaluation environment, and we reserve the right to refuse all future registration or purchase requests from the account holder.
5.6 Tax Obligations
Evaluation service fees displayed on the Website are inclusive of applicable indirect taxes. You are strictly and solely responsible for reporting and paying any personal taxes, duties, or levies assessed by your local jurisdiction in connection with any Performance Rewards or income you receive from utilizing our Services.
6. Trading Environment & Virtual Accounts
6.1 Evaluations
We offer various trading Evaluations with differing parameters, account sizes, and objectives (including Qualifying, and Reward-eligible stages). The specific scope, pricing, and rules of each Evaluation are detailed on the TRADERSYARD website.
6.2 Trading Platforms
The AgenaTrader-Client or AgenaTrader-WebTrader (collectively "AT") are provided to TRADERSYARD users for the execution of their evaluations. Your use of these platforms is strictly governed by AgenaTrader's terms and conditions, which can be reviewed at: https://agenatrader.com/terms-and-conditions/.
Please note that the AgenaTrader trading platforms are operated by AgenaTrader GmbH, a separate legal entity and sister company to TRADERSYARD.
By utilizing the AgenaTrader platforms in connection with a TRADERSYARD evaluation, you explicitly acknowledge and agree that your trading activities including but not limited to order data, trade execution details, and platform interactions will be processed and stored within the technical infrastructure of AgenaTrader GmbH. This data transfer and processing are strictly necessary for the provision of trading functionalities and the assessment of your Evaluation performance.
TRADERSYARD reserves the right, at its sole discretion, to integrate or mandate the use of additional or alternative trading platforms for its evaluations in the future.
6.3 Data Forwarding, Trade Data, and Independent Contractor Status
By using the Trading Platform, you acknowledge that TRADERSYARD has access to information stored in the environment of AgenaTrader (AgenaTrader GmbH) about your virtual trading activities. You authorize TRADERSYARD to share this information with entities that are either affiliated with TRADERSYARD through a corporate relationship or otherwise related to TRADERSYARD. You also authorize TRADERSYARD and these entities to handle the information as they see fit and in accordance with the GDPR. Please note that these activities may be automated and require no further consent or authorization from you. You are not entitled to any compensation or revenue in connection with TRADERSYARD's use of the data. It is important to understand that your virtual trading on the Platform does not constitute investment advice or recommendations to TRADERSYARD.
If you successfully advance to a Reward-Eligible stage, your relationship with TRADERSYARD will be strictly that of an independent contractor providing Simulated Data Deliverables. In this stage, the sole contractual consideration provided to you will be a "Performance Reward." This reward is calculated solely based on the simulated performance of your data deliverables within the Reward-Eligible virtual environment, and is entirely separate from any actual financial gain or loss TRADERSYARD may realize by utilizing your data.
6.4 Risk Provisions and Compliance
You are solely responsible for obtaining and maintaining the necessary technical equipment, internet connectivity, and software including any required third-party trading platform software at your own risk and expense. TRADERSYARD Services are primarily accessed via standard web browsers and designated trading applications. You assume all risks and costs associated with your hardware, software, and internet access. TRADERSYARD does not warrant or guarantee that our Services will be compatible with any specific device, operating system, or software program.
6.5 Service Interruptions and Third-Party Data
You acknowledge that access to the Services, user dashboard, and trading platforms may occasionally be interrupted due to maintenance, system upgrades, or unforeseen technical issues. TRADERSYARD assumes no liability, and you waive any right to compensation, for platform unavailability or for the loss, delay, or corruption of any data transmitted or stored via the Services.
Furthermore, the AgenaTrader platforms utilize financial market data supplied by independent third-party providers. While your use of these platforms is governed by AgenaTrader's Terms and Conditions (https://agenatrader.com/terms-and-conditions/), TRADERSYARD explicitly disclaims all liability and makes no guarantees regarding the accuracy, reliability, or continuous delivery of this third-party market data.
6.6 Trade Analysis and Data Publication
You agree that all trading activities executed during your Evaluations will be recorded, monitored, and analyzed within your user-specific dashboard environment. While you may choose to make your personal analysis data visible to the public, TRADERSYARD reserves the right to publish Evaluation performance data anonymized if necessary within public ranking portals or leaderboards.
7. Trading Rules, Limits & Prohibited Activities
7.1 Prohibited Trading Activities and Professional Conduct
You agree to execute all trading activities with discipline and in accordance with established, professional risk management standards. TRADERSYARD Evaluations are designed to assess genuine trading skill. Any attempt to circumvent risk management rules, exploit the simulated environment, or manipulate the platform is strictly prohibited.
Categories of Prohibited Conduct: While not exhaustive, TRADERSYARD strictly prohibits any trading activity that falls into the following categories:
- System Exploitation: Strategies designed to exploit simulated environment latencies, delayed data feeds, or software anomalies (e.g., arbitrage, gap-exploitation).
- Gambling and Unprofessional Behavior: Methodologies reflecting reckless risk management, an absence of definable strategy, or purely probabilistic gambling.
- Third-Party and Coordinated Trading: Account management by third parties, copy trading from external signals, or hedging across multiple accounts.
- Technical Circumvention: The use of VPNs, VPS, or malicious algorithms to mask identity or manipulate order flow.
The specific parameters, metrics, and technical definitions of prohibited strategies are maintained and updated on the TRADERSYARD Rules Page Trading Rules | TradersYard Challenge Requirements. By utilizing our Services, you explicitly agree to monitor and adhere to these dynamically updated Account-Specific Parameters. TRADERSYARD reserves the right to amend these operational rules at its sole discretion, and such updates shall be immediately binding. TRADERSYARD retains sole and absolute discretion in determining whether any specific trading activity constitutes a violation of these categories or the published rules.
In the event TRADERSYARD detects prohibited trading practices, we reserve the right to enforce disciplinary actions based on the severity of the violation, up to and including:
- The deduction of all profits generated by the violating trades from your account balance (which may result in a breach of your drawdown limits).
- The immediate suspension or permanent termination of all active Evaluation accounts and platform access.
- The forfeiture of any fees paid or performance rewards associated with the violating account.
7.2 Excessive Service Orders
To prevent platform abuse, TRADERSYARD monitors for an unusually high volume of evaluation orders placed by a single user within a short timeframe. Should we identify such activity, we reserve the right to issue a formal warning.
If the behavior persists, we may suspend your ability to place future orders. Furthermore, if we determine this excessive purchasing is connected to prohibited trading practices, we will enforce the measures outlined in Section 7 ("Prohibited Trade Activities").
7.3 Account Limits and Operational Restrictions
To ensure effective risk management and platform stability, TRADERSYARD reserves the right to impose limits on your account at any time, at its sole discretion. This includes, but is not limited to:
- Restricting the maximum number of active Evaluations or funded accounts a single user may hold simultaneously.
- Declining the purchase of new Evaluations or additional services.
- Limiting the maximum capital allocation assigned to any individual user.
TRADERSYARD operates proprietary risk management frameworks. We reserve the right to restrict further account purchases, limit access to specific asset classes, or transition your account to different trading conditions if your trading style, while not strictly violating Prohibited Trading Practices, fundamentally misaligns with our internal risk management strategies, simulated liquidity provision capabilities, or operational objectives.
Should TRADERSYARD decide to impose such operational restrictions, we will endeavor to notify you. Unless otherwise stated, these restrictions apply to future purchases and scaled allocations. Any currently active Evaluations or Independent Contractor agreements will continue to operate under their respective terms unless your conduct otherwise triggers a suspension or termination under the Termination Clause.
7.4 Futures Evaluations - Additional Restrictions and Requirements
7.4.1 Geographic Restrictions for Futures Evaluations
In addition to the general prohibited jurisdictions outlined in Section 3.6, participation in Futures Evaluations is subject to specific broker and exchange restrictions. You are strictly prohibited from participating in Futures Evaluations if you are a citizen, resident, or physically located in any of the following jurisdictions: Afghanistan, Algeria, Andorra, Angola, Bahamas, Barbados, Belarus, Botswana, Burkina Faso, Burma (Myanmar), Burundi, Cambodia, Central African Republic, Côte d'Ivoire, Cuba, Democratic Republic of Congo, Ecuador, Ethiopia, Ghana, Haiti, Iran, Iraq, Jamaica, Kenya, Laos, Lebanon, Liberia, Libya, Mali, Mongolia, Morocco, Mozambique, Nicaragua, Nigeria, North Korea, Pakistan, Papua New Guinea, Philippines, Russia, Senegal, Somalia, South Sudan, Sudan (including Darfur), Syria, Trinidad and Tobago, Uganda, Yemen, and Zimbabwe.
TRADERSYARD reserves the right to update this list at any time without prior notice to ensure compliance with legal, regulatory, and brokerage obligations. If you are found to be accessing a Futures Evaluation from a restricted jurisdiction, your account will be terminated immediately, and any fees, virtual profits, or Performance Rewards will be irrevocably forfeited.
7.4.2 Non-Professional Trader Status Requirement
To comply with applicable exchange data regulations, Futures Evaluations are strictly restricted to non-professional traders. You are expressly prohibited from participating in Futures Evaluations if you meet any of the following criteria:
- You are registered, licensed, or authorized as a financial professional (e.g., registered investment adviser, broker-dealer, or futures commission merchant).
- You hold professional financial certifications or designations (e.g., CFA, CMT, Series 7, or equivalent).
- You engage in trading activities as your primary profession or primary source of income.
- You have been employed by a financial institution, proprietary trading firm, hedge fund, or similar entity in a trading or investment capacity within the preceding twelve (12) months.
- You meet the definition of a "professional trader" or "professional client" under applicable regulatory frameworks, including MiFID II or CFTC regulations.
By participating in a Futures Evaluation, you formally represent and warrant that you are a non-professional trader. If TRADERSYARD determines that you qualify as a professional trader, your participation will be immediately terminated, and all pending Performance Rewards or entitlements will be forfeited without liability.
7.4.3 Specific Trading Rules and Limitations
Futures Evaluations operate under specialized risk management and trading parameters that differ materially from other TRADERSYARD offerings. These parameters include, but are not limited to:
- Performance Reward caps and withdrawal frequency limitations.
- Position size restrictions and maximum contract limits.
- Specific drawdown calculation methodologies (including static and end-of-day drawdowns).
- Profit target requirements and restricted trading instruments.
The complete and binding rules for Futures Evaluations are maintained on the TRADERSYARD Website (e.g., the Rules page). It is your sole responsibility to thoroughly review, understand, and comply with all Futures-specific rules prior to executing any trades. Failure to comply with any Futures Evaluation rule or restriction will result in immediate disqualification, account termination, and the forfeiture of any virtual profits or pending Performance Rewards, at TRADERSYARD's sole discretion and without obligation for refunds. TRADERSYARD reserves the right to modify these rules at any time, applicable to all future and ongoing trading activities where legally permitted.
7.4.4 Acknowledgment and Agreement
By registering for, accessing, or participating in any Futures Evaluation, you expressly acknowledge, represent, and warrant that:
- You are not a citizen, resident, or physically located in any of the restricted jurisdictions listed in Section 7.4.1.
- You are a non-professional trader as strictly defined in Section 7.4.2.
- You have thoroughly reviewed, understood, and agree to comply with all specific rules, limitations, and restrictions applicable to Futures Evaluations as detailed on the TRADERSYARD Website.
- You accept full and sole responsibility for ensuring your eligibility and ongoing compliance with these Terms.
Any false representation or breach of the foregoing warranties will result in the immediate termination of your account, the irrevocable forfeiture of any paid fees and pending Performance Rewards, and potential legal action, without prejudice to any other rights or remedies available to TRADERSYARD.
8. Tournaments, Competitions, and Promotional Accounts
8.1 Eligibility and Anti-Fraud Restrictions
Participation in Tournaments is strictly restricted to individuals aged 18 and older. Residents of any jurisdictions listed on the U.S. sanctions list (including but not limited to Cuba, Iran, North Korea, and Syria) are strictly prohibited from participating. You may only enter a Tournament once. Any attempt to circumvent Tournament rules by utilizing multiple email addresses, false identities, or alternate devices will result in immediate disqualification without refund. In the event of an identity dispute, the entry will be legally deemed submitted by the authorized account holder of the registered email address.
To ensure a fair and equitable environment for all participants, TRADERSYARD is committed to protecting the integrity of our platform against system abuse, exploitation, and bad-faith conduct. Consequently, TRADERSYARD reserves the right to decline, restrict, or suspend any user's participation in any Tournament or competition at its sole discretion. Decisions regarding eligibility and participation are final and may be enforced without prior notice.
8.2 Prizes, KYC, and Tax Obligations
To claim any Tournament prize, cash, or Evaluation account, you must successfully complete our KYC/AML verification process and provide accurate payment details. Prizes and rewards are strictly non-transferable and non-assignable. Physical goods or non-cash prizes cannot be redeemed for cash. As stated in Section 5.6, you are solely responsible for all federal, state, and local taxes associated with your winnings.
8.3 Sponsorships and Marketing Consent
If a competition is designated as a sponsored tournament (e.g., Survivor Showdown), your participation constitutes explicit consent for TRADERSYARD to share your user data with the respective event sponsors. Furthermore, by accepting a prize, you grant TRADERSYARD permission to use your name, likeness, and entry details for advertising, trade, and promotional purposes without further compensation, unless strictly prohibited by law.
8.4 Promotional and Giveaway Account Limits
Any Reward-Eligible Evaluation account awarded to you through a promotional giveaway, tournament prize, or other non-purchased means whether granted directly in its Reward-Eligible state or achieved by successfully passing a complimentary Evaluation account (collectively referred to as a "Giveaway Account") is strictly limited to a maximum of one (1) Performance Reward. Upon your submission of the first valid Performance Reward request for a Giveaway Account, the account will automatically be classified as closed, and no further trading or rewards will be permitted on that account.
9. Website Usage Rights & Obligations
9.1 Utilization and License Grant
The Website and all Services including the user dashboard, applications, data, information, computer code, user interfaces, and all multimedia elements such as text, graphics, designs, icons, images, and audio/video samples (collectively, the "Content") are protected by copyright and other intellectual property laws, and remain the exclusive property of TRADERSYARD or its licensors. TRADERSYARD grants you a limited, non-exclusive, non-transferable, non-assignable, and revocable license to access and use the Content strictly for your personal use, and solely in accordance with the intended purpose of the Services (participating in Evaluations). The Content is licensed, not sold or otherwise transferred to you, and all ownership rights remain entirely with TRADERSYARD or its licensors.
9.2 Access Conditions
These terms and conditions set out the terms on which you are granted access to the Website. By accessing the Website, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use the Website.
9.3 Copyrights and Intellectual Property Rights
Your use of the Website and its Content does not grant you any ownership or intellectual property rights, including copyright, trademarks, patents, design rights, trade names, database rights, or rights in know-how ("Intellectual Property Rights"). These Terms do not contain any provisions that would transfer any intellectual property rights from us to you or any third party.

All content is intended for general informational purposes only and is not tailored for any particular person or purpose. Furthermore, links to external third-party websites are provided solely for convenience. TRADERSYARD does not endorse, control, or monitor these external sites and accepts no liability for their content, security, or any loss or damage you may suffer from utilizing them. You acknowledge that TRADERSYARD is not a party to any transaction or dispute between you and any third party.
9.5 Acceptable Use of the Platform
You agree to use the Website strictly for its intended personal and Evaluation purposes. When accessing the Website or Services, you are expressly prohibited from:
- Engaging in any unlawful, fraudulent, or criminal activity.
- Using the platform for unauthorized commercial purposes, advertising, or distributing "spam."
- Transmitting malware, viruses, Trojans, or engaging in any activity harmful to the Website's infrastructure.

By submitting information, graphics, text, or other content ("Contributions") to TRADERSYARD or our connected community platforms (such as Discord), you grant us a perpetual, royalty-free right to edit, reproduce, publish, or remove such materials at our discretion. You represent and warrant that your Contributions comply with all applicable laws, are entirely your own (or you hold the necessary licenses), and are not confidential. You are solely responsible for backing up your content. TRADERSYARD utilizes Discord as a primary communication channel; your participation there is additionally governed by Discord's specific terms of service. The Website and community channels may feature content uploaded by other users. TRADERSYARD does not pre-screen, verify, or endorse user-generated content, and the views expressed by others do not represent the views or values of TRADERSYARD.
10. Affiliate Program Terms
10.1 Incorporation by Reference
By registering for and participating in the TRADERSYARD Affiliate Program, you expressly acknowledge and agree to be bound by the TRADERSYARD Affiliate Terms of Use, which are incorporated herein by reference and form an integral part of this agreement. 10.3 Modifications to the Affiliate Program
TRADERSYARD reserves the right to modify, update, or amend the Affiliate Terms of Use at any time. Active affiliates will be notified of material changes via email or through the affiliate dashboard. Your continued participation in the Affiliate Program following any such modification constitutes your legally binding acceptance of the updated terms.
11. Disclaimers, Liability & Indemnification
11.1 Liability Exclusion for Personal Trading and Third-Party Services
TRADERSYARD assumes no liability for any personal trading or investment activities you conduct outside of our Services. This includes any real-world financial market trading based on data, strategies, or information obtained from your user dashboard, the trading platform, or our educational materials. This exclusion of liability applies regardless of whether you utilize the same third-party trading software for both your TRADERSYARD evaluations and your personal brokerage accounts. Financial markets are highly volatile and inherently risky. You explicitly acknowledge that simulated trading results, past performance, and virtual profits generated within our platform are not indicative of, nor a guarantee of, future success in actual live market trading. Furthermore, TRADERSYARD accepts no responsibility or liability for the content, accuracy, or reliability of any third-party services, including educational webinars or external applications, accessed through our platform.
11.2 General Disclaimers and Site Availability
All content, services, and materials on the Website are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, TRADERSYARD makes no representations, warranties, or guarantees whether express or implied that the information on the Website is accurate, complete, or up-to-date. Limitation of Liability for Damages: Claims for damages by you are strictly excluded, except for damages arising from injury to life, body, or health, or from the breach of essential contractual obligations (cardinal obligations) necessary to achieve the purpose of the contract. Liability is also not excluded for damages based on an intentional or grossly negligent breach of duty by TRADERSYARD, its legal representatives, or its vicarious agents. In the event of a breach of material contractual obligations caused by simple negligence, TRADERSYARD's liability shall be strictly limited to the typically foreseeable damage. To the maximum extent permitted by applicable law, TRADERSYARD shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to lost profits, lost data, or personal/non-monetary damages caused by your use of the Services or reliance on any platform tool. In the event that TRADERSYARD's liability is determined by a court or competent authority, such liability shall be strictly capped at the exact amount of the fees you paid for the specific Service that resulted in the damage, up to a maximum of EUR 500.
11.4 Indemnification
You agree to fully indemnify, defend, and hold harmless TRADERSYARD, its affiliates, licensors, and employees from and against any claims, liabilities, damages, losses, or legal fees brought by a third party arising out of or related to: (a) your use or misuse of the Website and Services; (b) your breach of these Terms and Conditions; (c) your violation of any applicable law or third-party right; or (d) any User-Generated Content you submit.
11.5 Force Majeure
Neither party shall be held liable for any delay or failure to perform its obligations under these Terms if such delay or failure results from events, circumstances, or causes beyond its reasonable control. This includes, but is not limited to, acts of God, war, terrorism, strikes, epidemics, government actions, network interruptions, or any other force majeure events.
12. Account Termination & Inactivity
12.1 Account Inactivity
If you do not execute any trades or engage in any trading-related actions within your simulated account for a continuous period of ninety (90) days, the associated Evaluation account will be classified as inactive. TRADERSYARD reserves the right to suspend or permanently block access to the account due to inactivity. Reactivation of an inactive account is not guaranteed and remains subject to our sole discretion and review.
12.2 Account Deletion
You may request the permanent deletion of your user dashboard at any time by submitting a formal request to [email protected]. Such a request constitutes a formal notification of your intent to terminate your agreement with TRADERSYARD.
Upon receipt and processing of your request, TRADERSYARD will send a confirmation email, effectively terminating the contract. Consequently, your authorization to access all Services, including the user dashboard, active evaluations, and connected trading platforms, will be immediately revoked. You acknowledge and agree that voluntary account termination does not entitle you to any refund of fees previously paid or costs incurred.
12.3 Termination by Notice
Both parties acknowledge and agree that your access to the platform, Services, or any active agreements may be terminated at any time by written notice. Such termination shall be executed on terms determined in writing at the time of termination, which may include specific arrangements regarding outstanding Performance Rewards, account wind-down procedures, and transitional obligations.
12.4 Termination for Material Breach
You acknowledge and agree that TRADERSYARD shall be entitled to terminate your account and access to the platform with immediate effect by written notice, without liability, in the event of a Material Breach. A Material Breach includes, but is not limited to: engagement in any Prohibited Trading Practices; fraud, manipulation, or deliberate abuse of TRADERSYARD's technical infrastructure; providing false information or failing to pass and maintain KYC verification standards; violations of applicable laws that expose TRADERSYARD to liability; and any deliberate actions causing harm to TRADERSYARD's reputation, operations, or client relationships. In the event of such termination, TRADERSYARD shall have no obligation to make further payments beyond the Performance Rewards already accrued and verified prior to the date of the breach. However, if the Material Breach involves fraud, manipulation, AML violations, or a failure to satisfy Know Your Customer (KYC) verification requirements, all accrued, pending, or otherwise verified Performance Rewards shall be immediately and permanently forfeited.
12.5 Insolvency and Change of Control
In the event that insolvency proceedings are initiated against TRADERSYARD GmbH, or the company enters into statutory liquidation, the continuation or termination of the agreement, as well as the treatment of any user claims, shall be governed exclusively by mandatory Austrian insolvency law (Insolvenzordnung).
TRADERSYARD GmbH reserves the right to modify, suspend, or discontinue its services, including active Evaluations and Tournaments, in the event of a change of control, corporate restructuring, or cessation of business operations. In such an event, TRADERSYARD will endeavor to provide users with reasonable advance notice.
13. Final Provisions & Governing Law
13.1 Service Modifications
TRADERSYARD reserves the right to modify, change, replace, supplement, or eliminate specific elements, features, or functionalities of the Services at any time, without prior notice and without any obligation to pay compensation. We reserve the right to restrict or eliminate third-party offers or integrations on the Platform if we discover a violation of legal provisions by those third parties.
13.2 Jurisdiction and Local Compliance
The Website is operated and managed from Austria. We make no representation that the Services, Content, or platform features are appropriate, available, or legal for use in all jurisdictions outside of Austria. You are strictly and solely responsible for ensuring that your access to and use of the Website complies with all applicable local laws and regulations in your country of residence.
13.3 Governing Law and Jurisdiction
All legal relationships arising from or in connection with these Terms and Conditions, as well as all related non-contractual legal relationships, shall be governed exclusively by Austrian law. In the event of any disputes, the exclusive place of jurisdiction shall be Vienna, Austria, insofar as legally permissible. However, TRADERSYARD reserves the right to initiate legal proceedings at your general place of jurisdiction. These provisions do not affect the mandatory consumer protection laws of your country of residence within the European Union or other applicable legal systems.
13.4 Out-of-Court Online Dispute Resolution (ODR)
The European Commission provides a platform for out-of-court online dispute resolution (ODR), which can be accessed at: https://ec.europa.eu/consumers/odr/. Please note that TRADERSYARD does not participate in alternative dispute resolution proceedings within the meaning of the ODR Regulation, nor in consumer arbitration proceedings within the meaning of the Consumer Dispute Resolution Act (VSBG), and is under no legal obligation to do so.
13.5 No Class or Collective Actions
To the maximum extent permitted by applicable law, you agree that any claims, disputes, or legal proceedings against TRADERSYARD must be brought strictly in your individual capacity. You expressly waive any right to participate as a plaintiff or class member in any purported class action, collective, consolidated, or representative proceeding.
13.6 Severability
If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable while preserving the original economic and legal intent of the parties.
13.7 Entire Agreement and Order of Precedence
These Terms and Conditions, alongside any incorporated policies, rules, or external agreements explicitly referenced herein, constitute the entire and exclusive agreement between you and TRADERSYARD. They supersede and replace all prior or contemporaneous agreements, communications, understandings, and proposals, whether oral or written, relating to the subject matter contained herein.
In the event of any direct conflict, inconsistency, or ambiguity between these General Terms and Conditions and an executed TRADERSYARD Master Agreement (such as an Independent Contractor Agreement entered into upon advancing to a Reward-Eligible stage), the terms and provisions of the TRADERSYARD Master Agreement shall strictly prevail and supersede these Terms and Conditions to the extent of such conflict.
